Clarification made by T. Giesen that 8 Woods St. is zoned institutional
and the use as a licensed establishment pre-dates the zoning by-law.

Laine
H. Phillips (owner of property adjacent to applicant’s south property
line) spoke of his support of the application and his belief that a patio would
be beneficial.
L. Irvine inquired about the use of a visual barrier between pedestrians
and the patio. The applicant indicated that cedars would be planted to address
this issue.
J. Merrell questioned how the extent of the patio use would be
controlled. Through consensus it was decided that a condition should be
attached that would limit the patio to the currently requested dimensions and
location.
M. Aldred discussed the fact that the application was for a use that
required no structure and would through the constraints of climate be seasonal.
This was confirmed by the applicant.

Reasons:

The development and
its location is desirable for the use of the land

The use is minor in
nature based on the fact that proposed use area is part of a consolidated
property that includes three lots

IT IS THE DECISION of the Committee of
Adjustment of the Town of Kirkland Lake that Marya
H. Laine be granted a Minor Variance to:
Established a licensed outdoor patio for 8
Woods St. on part of 10 Woods St.
to
accommodate a seasonal use.
Conditions:
As per schedule “A”
by which the 20’x20’ patio dimension and its
location are indicated
NOTICE IS HEREBY GIVEN that the last date
for appealing this decision to the Ontario Municipal Board is May. 24, 2010 by filing with the Secretary of
the Committee of Adjustment a Notice of Appeal setting out written reasons in
support of the appeal accompanied by a fee of $125.00.
Only individuals, corporations and public
bodies may appeal Decisions in respect of applications for Consent to the
Ontario Municipal Board. A notice of
appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in
the name of an individual who is a member of the association or group on its
behalf.
